The Toll Pass Waiver lets you use covered toll roads, bridges and tunnels without being responsible for the tolls. Express and premium lanes are excluded. Here are the full terms.
If purchased, Bandago's Toll Pass Waiver ("TPW") allows the Renter to use Covered Toll Facilities during the Rental Period without being responsible for Eligible Toll Charges incurred by the Vehicle, subject to the terms and exclusions below.
TPW applies to tolls charged for ordinary travel on toll roads, toll highways, toll bridges and toll tunnels within the United States ("Covered Toll Facilities").
A facility may be a Covered Toll Facility even when a toll-free alternate route is available. For example, a toll highway may be covered even though the Renter could have chosen a different, non-tolled highway or local road.
Bandago will be responsible for toll charges assessed to the Vehicle for use of a Covered Toll Facility during the Rental Period, including the ordinary toll authority's applicable license-plate, video-toll or pay-by-plate rate where electronic license-plate billing is the normal method available to the Vehicle.
There is no per-toll limit on Eligible Toll Charges, subject to the exclusions and reasonable-use provisions below.
TPW does not cover charges associated with use of an optional express lane, high-occupancy toll ("HOT") lane, managed lane, dynamically priced lane, congestion-relief lane or other premium lane when general-purpose lanes on substantially the same roadway are available without payment of that charge.
This exclusion applies regardless of the number of occupants in the Vehicle and regardless of whether the Vehicle might otherwise qualify for free or discounted travel if equipped with an appropriate transponder or enrolled in a toll program.
Any toll, fee, processing charge, penalty or citation resulting from use of such a lane is the responsibility of the Renter.
Bandago does not provide a toll transponder with TPW.
TPW is a waiver of the Renter's responsibility for Eligible Toll Charges; it is not a toll account, transponder service, express-lane pass, HOV permit or authorization to use any roadway or lane that requires a transponder, account, vehicle registration or other equipment.
The Renter is responsible for knowing and complying with all posted roadway and lane requirements.
If a toll facility or lane requires a transponder or registered toll account for lawful use, TPW does not authorize the Renter to use that facility or lane without one.
The Renter may use a personally owned or separately obtained toll transponder or toll account where permitted by the applicable toll authority.
Bandago is not responsible for charges billed directly to the Renter's personal transponder or toll account, and TPW does not provide reimbursement for tolls or other charges paid directly by the Renter.
The Renter is responsible for properly adding and removing the Vehicle from any personal toll account and for avoiding duplicate toll charges.
TPW does not cover:
Any excluded charge assessed to Bandago because of the Renter's use of the Vehicle may be charged to the Renter together with any administrative fee permitted under the Rental Agreement.
TPW does not waive the Renter's responsibility to comply with traffic laws, occupancy requirements, toll-authority rules, posted restrictions or transponder requirements.
If a toll authority characterizes the Vehicle's use as a violation rather than an ordinary toll transaction (including because a required transponder was not present), the resulting toll, violation amount, processing fee, penalty or other charge is not covered by TPW.
TPW applies only to eligible travel occurring between the time the Vehicle is released to the Renter and the time the Vehicle is returned to Bandago.
A toll may be covered even if Bandago receives the toll notice after the Rental Period, provided that the underlying eligible toll transaction occurred during the Rental Period.
TPW is intended for ordinary travel associated with the Renter's use of the Vehicle and may not be used for commercial toll avoidance, repeated passage through a toll point primarily for the purpose of generating toll charges, or other fraudulent or abusive activity.
Bandago may charge the Renter for tolls resulting from fraudulent or intentionally abusive use of TPW.
Toll rates, classifications, discounts, roadway rules and billing practices are established by third-party toll authorities and may change without notice.
Bandago does not guarantee that any particular roadway or lane is toll-free, that the Vehicle qualifies for an occupancy or other discount, or that a toll authority will recognize the Vehicle as eligible for free or discounted travel.
If there is a dispute regarding whether a charge is an Eligible Toll Charge, Bandago's determination will be based on the nature of the facility, the toll authority's characterization of the charge, and these Terms and Conditions.
TPW modifies only the Renter's financial responsibility for Eligible Toll Charges. Except as expressly stated above, all provisions of the Rental Agreement remain in effect.
